Privacy Policy

Overview

This Privacy Policy explains Fathom Studio L.P.'s ("Fathom's") information-gathering and dissemination practices for our website: www.delgo.com (the "Site"). This Site is the official web site of the movie Delgo ("Delgo"). The Site is dedicated to providing Delgo fans with news, features, and other information for maximizing the Delgo movie experience when the film is released.

Fathom takes your privacy rights seriously and has posted this Privacy Policy to let our users know what information we collect from you, why we collect it and what we do with it. Fathom's goal is to collect and use only that information that we think is necessary for our legitimate business interests, such as to better understand and serve you (the community of Delgo fans), to provide better service, and to improve marketing of the Delgo movie and other products that we believe may be of interest to you.

Acceptance of These Terms

This Privacy Policy is incorporated into and is subject to the Fathom Terms and Conditions of Use for the Site. If you do not agree to the terms of this Privacy Policy or the Terms and Conditions of Use for the Site, please do not provide us with any information and do not use the Fathom Site or the Site's services. Your continued use of the Fathom Site in light of changes to this Privacy Policy will signify your acceptance of the changes for information gathered after the date of the change.

Does this Privacy Policy apply to you?

This privacy policy covers Fathom's information collection and use practices for anyone who uses the Site. Except as otherwise set forth in this Privacy Policy, Fathom will not share your personally identifiable information with any third parties unless you give us permission to do so or except as required by law or to cooperate with law enforcement authorities.

This Site, however, contains links to other websites, advertisers and other third parties. By clicking on any of these links, you are leaving the Site. A link provided on the Site does not constitute an endorsement of the content, viewpoint, accuracy, opinions, policies, products, services or accessibility of that linked web site. Fathom has no control over the information collected from or about you by any third party after you have left the Site. This Privacy Policy does not cover the data collection and use practices of any third party linked to Fathom. Fathom assumes no liability and is not responsible for any practices of such third party web sites, including their privacy practices, content, or other activities. Once you link to another web site from the Site, you are subject to the terms and conditions of that web site, including, but not limited to, its Internet privacy policy.

What information, including personally identifiable information, does Fathom collect from and about you?

In order to provide you with our services, there are two methods whereby we collect information from you: passive collection of technical information and information you voluntarily provide to Fathom, including personally identifiable information.

Passive Collection of Technical Information.

Fathom automatically collects certain technical information from each visitor, including your IP address, the type of browser you use to surf the Internet, your computer's operating system, and the web site from which you accessed the Site. Your IP address tells us both your Internet Service Provider (ISP) and the general geographic location from which you are connecting. We may also use your IP address to track how long you stayed on the Site and what pages you visited. This information is used internally by Fathom to help us provide a good web experience to Delgo fans, including providing proper formatting for our web pages and analyzing which aspects of the site are most effective, as well as optimizing the marketing of Delgo.

In addition, Fathom uses Cookies on this Site. Cookies are small text files that are sent from a server computer to your computer during a browsing session so that the web site may track your activities on the web site and identify you on return visits. Cookies are typically stored on your computer's hard drive and are used by web sites to simulate a continuous connection to that site. Cookies, by themselves, do not necessarily let a web site know any personally identifying information about you, such as your real name, address, etc., unless you previously provided that information at the web site or have set your preferences in your browser to provide that information. Fathom is not generally interested in any one individual and does not collect personally identifiable information about any one person using Cookies. Fathom does, however, use Cookies to save your preferences so that the Site has the same appearance each time you access it. Most web browsers permit users to control the use of Cookies by refusing or deleting Cookies at any time. Refusing or deleting a Cookie may, however, limit your ability to take advantage of some features of this Site.

Information You Provide.

At delgo.com, we do not collect personally identifiable information on our Site unless our visitors voluntarily provide it to us. For some activities, such as online polls or surveys, we may ask visitors to provide information that is not personally identifiable. This might include first name only, city or state of residence, age, gender, or a favorite character. For some other activities, such as entering sweepstakes and contests, we may ask visitors to provide a first name and e-mail address.

When a child under age thirteen participates in an ongoing activity that requires the collection, retention, and use of personal information, we will also ask for a parent's e-mail address so that we can notify the parent that we have received personal information from their child. We do not knowingly collect names and e-mail addresses from children under age thirteen for these types of activities without notifying the parent via e-mail and giving the parent the option to remove their child's e-mail address from the applicable database for that activity. For specific one-time requests we receive from visitors, e-mail addresses are collected and used only in connection with the specific one-time request. For example, for sweepstakes and contests, e-mail addresses are collected for the purpose of entering the online sweepstakes or contest on a one-time basis and are used to notify winners of the sweepstakes or contest once by e-mail. Winners will be required to return a completed prize acceptance form contained in the notification e-mail by facsimile or U.S. mail within a designated time period (along with the signature of a parent or legal guardian for all minors).

Fathom's use and disclosure of the information you provide us, including personally identifiable information is set forth below.

What other organizations besides Fathom may be collecting information from you on the Site?

Fathom may use outside advertising companies to display banner advertisements on the Site. Banner advertisements may also contain cookies, and appear to be coming from Fathom; but, in reality, they are coming from third parties who are serving advertisements on the Site. Fathom has no control over the privacy practices of any third party, and the manner in which any third party uses your information is not protected by the terms of this Privacy Policy. Further, once you leave the Site, Fathom does not control the privacy policies or the privacy practices of any third parties.

How will Fathom and its marketing partners use my information?

We use visitors' personal information collected in connection with child-directed activities for internal purposes only, such as enabling visitors to enter our online contests or sweepstakes or to subscribe to an online newsletter.

We do not keep any personal information we obtain through a contest or sweepstakes until we have successfully selected a winner(s), awarded the prize(s), and administered the contest or sweepstakes. We only use the e-mail addresses of subscribers to our Sites' e-mail newsletters to send them the requested newsletter(s). Each newsletter also includes instructions for subscription removal via return e-mail.

We never sell, rent, or otherwise share our visitors' personal information with third parties without appropriate consent. Sometimes, we use agents or contractors to provide services to our visitors, such as helping us conduct a sweepstakes, sending prizes to winners, shipping customer orders made on the Sites, or providing customer service related to activities on the Sites. In these cases, we require the agent or contractor to keep the information confidential and to use it only for the specific services they are performing. We sometimes use non-personally identifiable information that we collect to improve the design and content of our Sites, and to improve our visitors' experience on the Sites. We also may aggregate this information to analyze Site usage, as well as to offer products, programs, or services.

We may disclose personally identifiable information in response to legal process, for example, in response to a court order or a subpoena. We also may disclose such information in response to a law enforcement agency's request, or where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms of use, to verify or enforce compliance with the policies governing our Sites and applicable laws, or as otherwise required or permitted by law or consistent with legal requirements. In addition, we may transfer personally identifiable information about you if we or one of our business units are acquired by, sold to, or merged with another company.

We will not use or transfer personally identifiable information in ways that are materially different from the ones described above without also providing parental notification of such practices and obtaining consent for any materially different uses.

What kinds of security procedures are in place to protect the loss, misuse or alteration of information under Fathom's control?

Fathom uses industry standard security measures to protect the loss, misuse and alteration of the information under our control. Nonetheless, due to the inherent dangers of the Internet, we cannot guarantee the protection of such information against loss, misuse, or alteration.
